ABC 7 News reports that on Sunday, May 20, around 6 p.m., the driver of a Chevy Tahoe jumped the curb onto a side walk in South Los Angeles and crashed into a mother and her 2-year-old son who were out for a walk. Eidan Cortez, the young child, was tragically killed as a result of this Los Angeles pedestrian accident.
Prosecutors say that the driver of the Tahoe, a 32-year-old Gardena man, George Milton, was intoxicated at the time of the accident—his blood alcohol content was right at .08, the limit in California. Once Milton struck the young boy, he reversed, hitting the child again. Milton “allegedly tried to flee the scene, but bystanders helped restrain him until police arrived.”
The driver will now face charges of gross vehicular manslaughter while intoxicated, driving under the influence of an alcoholic beverage causing injury and driving with a .08 percent blood alcohol content causing injury for which he can face up to 25 years in prison.
In this case, the family of young Eidan Cortez can file a wrongful death claim against the driver of the Tahoe, as the driver was intoxicated, and it is likely his intoxication caused the death of Eidan Cortez.
